Detail Connect Affiliate Program Terms and Conditions

Effective Date: August 6, 2025

These Affiliate Program Terms and Conditions (“Terms”) govern your participation in the Detail Connect Affiliate Program (“Program”). By applying, participating, or receiving a referral code, you agree to comply with and be bound by these Terms.

1. Eligibility
You must be at least 18 years of age.
You must own or manage an active, public social media platform suitable for brand-aligned promotion.
We reserve the right to approve or reject any affiliate application at our sole discretion.

2. Referral Code Usage
Approved affiliates will receive a unique referral code.
This code grants new users $10 off their first vehicle detail when booked through the Detail Connect app.
Each code is valid only for first-time customers.

3. Commissions and Payouts
Affiliates earn 50% of the profit that we make per valid customer referral that results in a completed, non-refunded detail appointment.
Payouts are processed monthly via PayPal.
The is no minimum payout threshold.
Any chargebacks, cancellations, or refunds will void the associated commission. If already paid, we reserve the right to deduct it from future payouts.
You are solely responsible for reporting and paying any applicable taxes.

4. Promotional Guidelines
All promotional content must:
Accurately represent Detail Connect.
Follow FTC guidelines for influencer marketing (e.g., include #ad or #sponsored if applicable).
Avoid false claims, overstatements, or unverified guarantees.

You must not:
Promote Detail Connect on websites or content containing hate speech, violence, adult material, or illegal activity.
Engage in click fraud, fake account creation, or self-referrals.
Use paid search ads that bid on “Detail Connect” or similar branded terms.
Disclose confidential internal communications or unreleased features.

5. Content Ownership and Licensing
By participating in the Program, you grant Detail Connect an irrevocable, non-exclusive, royalty-free, worldwide, perpetual license to:
Reuse, repost, adapt, modify, and share any content you create that mentions or promotes Detail Connect.
Use your content for marketing, social media, email, paid ads, internal documentation, and other business purposes.
You agree that this usage does not require additional approval or compensation beyond your affiliate commission.

6. Content Removal
Detail Connect reserves the right to request the removal of any content—with or without cause—that includes:
Mentions of our name, logo, branding, employees, partners, or platform features.
If asked, you must remove the content within 48 hours of receiving our request.

7. Right to Monitor and Audit
We reserve the right to monitor your promotional activity at any time.
This includes verifying referral sources, reviewing traffic quality, and ensuring compliance with these Terms.
Failure to comply may result in termination and forfeiture of any unpaid commissions.

8. Confidentiality
Affiliates may receive access to non-public information about Detail Connect's platform, strategy, or upcoming features.
You agree to keep such information confidential and not disclose or share it publicly or privately.

9. Non-Disparagement
You agree not to make or publish any statements (publicly or privately) that could reasonably harm the reputation of Detail Connect, its team, affiliates, or customers.

10. Inactivity and Termination
If your affiliate account remains inactive (no successful referrals) for 60 days, we may remove you from the program.
You may voluntarily withdraw at any time by notifying us.
Detail Connect may terminate your participation at any time, with or without cause.
If terminated for breach or fraud, all pending commissions may be withheld.

11. No Partnership or Employment
Nothing in this agreement creates a joint venture, partnership, employment, or agency relationship between you and Detail Connect.

12. Taxes and W9 Requirement
U.S.-based affiliates earning $600 or more annually must submit a completed W9 form before further payouts are issued.

13. Tracking Disclaimer
Manual credit will not be given without verifiable proof.

14. Dispute Resolution
Any disputes arising from this Program shall be resolved by binding arbitration in the State of PA.
Each party is responsible for its own legal costs.

15. Social Media Policy
Affiliates must not:
Promote Detail Connect in spammy or unethical ways.
Violate platform terms (e.g., TikTok, YouTube, Instagram).
Engage in any hate speech, harassment, or create offensive content.

16. Use of Testimonials and Feedback
By sharing reviews, messages, or feedback about the Program, you agree Detail Connect may quote or reference your content in marketing materials.

17. Changes to Program Structure
Detail Connect reserves the right to change:
Commission amounts
Payout schedules
Referral discount structure
Eligibility requirements

You will be notified at least 7 days in advance of material changes.

18. Indemnification
You agree to indemnify, defend, and hold harmless Detail Connect, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your participation in the Affiliate Program, your breach of these Terms, or your violation of any applicable law or the rights of any third party.

19. No Guarantee of Acceptance
Submission of an application does not guarantee inclusion in the Affiliate Program. We reserve the right to reject any application or remove any affiliate at our sole discretion and without explanation.

20. Finality of Tracking Data
All referral and commission data recorded by Detail Connect's tracking system is deemed final. We do not make manual adjustments or overrides based on screenshots, verbal claims, or anecdotal reports.

21. Ownership of Referred Users
All users referred to Detail Connect through your affiliate link or code become customers of Detail Connect. You acknowledge that you do not have any ownership, rights, or control over these users beyond the referral commission associated with their initial transaction.

22. Program Suspension or Termination
We reserve the right to suspend, modify, or terminate the Affiliate Program, or your participation in it, at any time and for any reason. Any pending commissions at the time of termination (not resulting from fraud or violation) will be honored.

23. Compliance with Laws
Affiliates agree to comply with all applicable local, state, federal, and international laws, regulations, and tax requirements in connection with their participation in the Program.

24. Governing Language
In case of conflict between any translations of these Terms and the English version, the English version shall prevail.

25. Governing Law
These Terms are governed by the laws of the State of PA, without regard to conflict of law principles.

26. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

27. Entire Agreement
These Terms constitute the entire agreement between you and Detail Connect concerning your participation in the Affiliate Program and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral.
